Mititech Receives DHS Safety Act Certification for its Safety Drape Systems

MitiTech, LLC (dba Mitigation Technologies) proudly announces that it has received liability protections from the Department of Homeland Security ("DHS") that will dramatically benefit its customers. MitiTech has been granted coverage under a new Federal law known as the "Support Anti-Terrorism By Fostering Effective Technology Act" (the "SAFETY Act") for its Safetydrape™ blast mitigation systems and associated services (including instructions and personnel certification). As explained below, the tort protections that accompany SAFETY Act coverage will result in dramatically lower liability risks for MitiTech and its customers should a future act of terrorism occur.

Following the horrific terrorist attacks of September 11, a number of lawsuits were filed against airports, airplane manufacturers, security companies, and government entities like the Port Authority of New York/New Jersey. A Federal judge has permitted those lawsuits to proceed, saying that the use of an airplane as a suicide weapon was potentially foreseeable. As a result, the potential liability costs for all providers and users of anti-terror products and services have become virtually unlimited.

The Federal government, recognizing that such massive liability would crush the research, development, sale and use of anti-terror technologies, passed the SAFETY Act as part of the Homeland Security Act of 2002. In short, the SAFETY Act essentially eliminates liability that could arise out of a terrorist attack for sellers whose anti-terror products or services have been reviewed and approved by DHS.

Most important, these tort protections extend to you, our customers, should a future act of terrorism occur where you have purchased and deployed MitiTech's Safetydrape™ blast mitigation systems and associated services. Should an act of terrorism occur and lawsuits follow alleging that MitiTech's products and associated services deployed by you failed to prevent the terrorism, you have a substantial basis to seek immediate dismissal of such suits against you. You will not enjoy such protection if you buy similar technology that has not been SAFETY Act approved.

Under the SAFETY Act application filed by MitiTech, it specifically sought and received from DHS SAFETY Act coverage for its Safetydrape™ blast mitigation systems and associated services. MitiTech's customers can now use its products and services knowing that they are a substantial basis to avoid potential tort liability arising out of an act of terrorism. Further, MitiTech customers should report immediately to their insurers the use of MitiTech's SAFETY Act approved products and services, as that information could result in lower premiums given the elimination of tort risk should an act of terrorism occur. Craig Schwartz, Safetydrape™ inventor and managing member of the company said, "Now our 15 year old tag line, 'Ensuring your safety, comfort, and peace of mind' carries even more weight especially in the 'peace of mind' category."

Finally, we anticipate that government procurements will soon require the use of SAFETY Act approved products and services, and so MitiTech customers will be ahead of the curve for those programs.

MitiTech is proud to be one of the first recipients of SAFETY Act coverage from DHS and even more delighted to offer its approved technologies and tort protections to its customers. MitiTech utilized the services of Ray Biagini and Brian Finch at McKenna Long & Aldridge LLP in obtaining SAFETY Act coverage. Mr. Biagini authored one of the key provisions of the SAFETY Act.
